BOOKING TERMS AND CONDITIONS FOR HOLIDAY ACCOMMODATION

1. DEFINITIONS

“Booking” means the period for which you have paid to stay at the Property.

“Property” means Property named and all its fixtures, fittings and equipment.

“Management” means the owners and managers of the Property.

"Guests" means the persons who stay overnight in the Property during the Booking.

"Visitor" means a person a Guest permits to visit the Property during the Booking.  

2.  ACCEPTANCE & RESPONSIBILTIES

2.1 Payment of the Deposit constitutes acceptance of these Terms and Conditions.

3. TERMS ABOUT YOUR BOOKING   

3.1   Deposit and Payment Terms

3.1.1 The deposit, as stipulated in the “Confirmation of Booking” must be received within the stipulated number of days after the Booking is taken by Management. Bookings are not confirmed unless and until this deposit is received.

3.1.2 You must pay the final payment at least 28 days prior to the Arrival Date; or if you make your booking less than 30 days prior to the Arrival Date then payment in full must be made at the time of booking.

3.1.3 If the Deposit or final payment is not received by the due date, we may cancel the booking, without any requirement to notify you.

3.2   Cancellations or Variations

A booking cancelled by you after acceptance by us and payment of the Deposit is subject to cancellation fees as follows:

3.2.1 The 25% Booking Deposit (50% if within 3 months) is non-refundable. The 25% deposit which is non-refundable is transferable to other dates in the same accommodation, up to 3 months prior to arrival.

3.2.2 The balance (due 28 days prior to arrival) is non-refundable and non-transferable, unless the booking can be replaced. In that case an AU$150.00 cancellation fee applies. We recommend that you consider arranging TRAVEL INSURANCE to protect against possible loss in case of personal circumstances, or unforeseen events, that could result in a late cancellation.

3.2.3 Dates are transferable to another date within the same property. A surcharge of 5% applies to the initial (booking) total tariff. Note this is in addition to clause 3.2.6.

3.2.4 A variation of the Booking which reduces the number of nights stay will be a treated as a cancellation of the Booking in respect of those nights.

3.2.5 A variation of the Booking which reduces the number of guests will be treated as a cancellation of the Booking in respect of those guests.

3.2.6 An administration charge of AU$150.00 will be charged for any variation or cancellation. Note this is in addition to clause 3.2.3.

3.2.7 If you made payment through the online Stayz Payment system and you wish to vary or cancel your booking please log in to http://www.stayz.com.au/login and amend your booking.

Should you be eligible for a refund it will be made through the Stayz Online Payment System and then credited to the credit card linked to your Booking.

3.3   Prices, Payment Options & Invoicing

3.3.1 Prices are in Australian dollars (AUD) and all payments must be made in Australian dollars.

3.3.2 Payment will only be credited when cleared funds are received.

3.3.3 We are not responsible for delays in bank or payment system processing. It is your responsibility to ensure that payments are received within the times specified.

3.3.4 Direct deposit payments may be made to us. Account details will be provided at the time of booking. Please ensure that you quote your surname or the reference number from your Booking Agreement. 

3.3.5 We are not liable for and not required to honour any pricing displayed that is quoted in error. Confirmation and invoices are subject to re-issue if incorrect through error or omission and you agree to then pay the correct cost or to cancel the booking. A cancellation under these circumstances does not incur any cancellation fee.

3.3.6 Payments accepted include EFT (Electronic Transfer of Funds), and/or credit card via online payments through stayz.com.  Payment through the stayz online system incurs a fee.

3.3.7 When using the Stayz Online Payment System, your Booking is split into two portions – the non-refundable deposit and the remaining balance. You may pay both portions (the full amount) in Australian Dollars, up-front or pay the deposit initially and subsequently pay the remaining balance.

Balance of the rental amount will be automatically debited 28 days (or thereabouts) prior to occupancy. If you have insufficient funds available for debit at that time you will be responsible for payment of all fees and charges. Where your stay commences in less than 4 weeks from the time of Booking, the full amount must be paid in full up front.

3.4   Arrival and Departure

3.4.1 All bookings include 1x on island arrival and 1 x departure transfers for up to 6-7 people. The Keys will be supplied on arrival and must be returned at departure.

3.4.2 Standard check in is 2pm and standard check out is 10am.

3.4.3 Late check in / checkout may incur a fee. If you desire an early check in / late check in or late checkout then enquiries should be made at the time of booking.

3.4.5 Late checkout is at our discretion and must be requested the night before check out; and may incur a fee.

4.  TERMS ABOUT YOUR OCCUPANCY

4.1   Conditions of use

4.1.1 You agree to ensure that all occupants treat the Property and all fittings with reasonable care and you agree to pay for any damage caused by misuse, neglect or abuse during your occupancy.

4.1.2 You agree to ensure that all occupants act in a manner that does not cause any nuisance or disturbance to nearby occupiers.

4.1.3 Pets are not permitted. This does not apply to Seeing Eye dogs.

4.1.4 You agree to comply with all applicable laws and with the regulations of Hamilton Island Enterprises Limited.

4.1.5 You agree to vacate the Property in a reasonably clean condition, including all barbeques and other fittings. You agree to pay any reasonable excess cleaning fees if the Property is not left in a clean condition.

4.1.6 Mobile telephone reception on the island is generally good. There is an internet café and there are several wireless internet hot spots on the island. Usual phone connections permit calls within the island only. Such calls are at no additional cost.

4.1.7 You agree to not exceed the maximum number of occupants specified for the Booking.

4.2   Security Bond

4.2.1 You agree to provide a credit card to hold as a Security Bond before arriving on Hamilton Island. This includes name on Credit Card, Credit Card number, Expiry date and CVV. Entry to property will not be allowed until credit card details are disclosed.
Please note we do not accept cash as security bond.

4.2.2 You agree that we may draw upon the Security Bond to make good any damages. Any damage loss or expense incurred by Management as a result of your breach of these Terms & Conditions will be charged against the credit card. Examples include but are not limited to any breakage, damage or excess cleaning requirements, extra Guests or Visitors beyond those declared. You will be notified before any transactions occur.

4.3   Items left behind

4.3.1 You will be notified if we find any items left on the Property that may belong to you.

4.4 Problems or Complaints

4.4.1 In the case of any problem or complaint, you must inform the booking agent at the earliest opportunity so that the agent has the chance to rectify the situation as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours.

4.4.2 Any complaint, which cannot be resolved locally, must be notified in writing to the agent prior to departure from the Property.

4.4.3 Failure to follow this procedure may hinder the ability of the owner to rectify the problem or complaint and reduce or extinguish any claim you may have.

4.4.4 We recommend all guests purchase travel insurance since the owner are not responsible for any injuries, illness or accidents that may occur whilst staying at our property.

5. TERMS ABOUT USE OF THE GOLF BUGGY

A golf buggy will be supplied complimentary for your use while staying at the Property. You agree with us that:

5.1   The buggy is supplied "as is". We are not liable to compensate you for the unavailability of the buggy, or for any defect or break down in the functioning of the buggy, regardless of cause.

5.2   The golf buggy will only be driven by an adult person with a valid driver’s licence, who is designated as a driver in the Booking Agreement;

5.2.1 You will be responsible for any damage caused during your stay. If any insurance claims arise you are to bear the excess cost of $500 for each and every claim. Age clause under 25 years is $1000 for each and every claim. Buggies are registered vehicles – Police and Island Security monitor driver behaviour, including breath tests.

5.3   You will not drive (and you will not permit any other designated driver to drive) the buggy:

5.3.1 Between 1.00 a.m. and 5.30 a.m. (Hamilton Island buggy curfew);

5.3.2 With a blood alcohol content in excess of 0.05%, or while adversely affected by drugs (prescription or otherwise);

5.3.3 In any area sign posted "No Buggies" or "Restricted Area";

5.3.4 On any unsealed road, grassed area, air strip, beach or other "off-road" area;

5.3.5 Contrary to any road sign; or

5.3.6 Faster than 20 kilometres per hour.

5.4   You will drive the buggy (and will require any other designated driver to drive the buggy) in a safe and reasonable manner and in particular will ensure that a driver:

5.4.1 Does not contravene any Queensland road traffic regulations;

5.4.2 Does not contravene any Hamilton Island traffic regulations;

5.4.3 Does not carry more than the specified maximum number of passengers;

5.4.4 Removes the ignition key from the buggy when it is not in use.

5.4.4.1 If the buggy is stolen, in which case the occupant may need to cover any ignition replacement fees.

5.5   You will charge the buggy appropriately prior to returning it, for the next guests.

5.6   You will return the buggy in a clean, tidy and undamaged condition, fair wear and tear excepted. You agree that tyre damage, under body damage, overhead damage and windscreen damage are not fair wear and tear.

5.7   You will use the buggy entirely at your own risk; and that Hamilton Island Holiday.com will not be liable for any loss, damage, personal injury or death resulting from your use of the buggy.

5.8   You agree to indemnify us against any loss or damage arising out of:

5.8.1 Any damage to the buggy or the Property, any injury to or death of any person, any damage to your property or the property of any third party and any consequential loss, cost (including legal costs) or expense of any kind arising out of the negligent use of the buggy by any person using the buggy with your permission;

5.8.2 Any charges claimed by Hamilton Island Enterprises Pty Ltd for parking or traffic violations while the buggy is in your care;

5.9   You agree that:

5.9.1 The cost of additional cleaning or repairs; and

5.9.2 In the event that the buggy does not operate, through misuse or negligence the owner is not responsible for a replacement buggy. The owner/agent will endeavour to resolve any problems to the best of their ability. No guarantee (refer clause 3.1).
5.10 CHILD RESTRAINT LAWS with respect to Golf buggies.

6. YOUR OTHER RESPONSIBILITIES

6.1 You must comply with all applicable House Rules and all instructions from Management and the caretakers of the Property concerning occupancy, property, health, safety and quiet enjoyment of the Property and our neighbours.

6.2 You are responsible for damage, breakages, theft and loss of the Property and any part of it during your stay. You must notify us of this immediately. Management may recover from you, repair or replacement cost (at Management's discretion).

6.3 Only the guests nominated and agreed in the Booking may stay in the Property over night. If any other guests stay extra charges may apply or the agreement may be terminated without refund.

6.4 Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination and eviction without refund and extra charges may be made for security and other expenses.

6.5 Before departure, all food must be removed from fridges, all rubbish put in the appropriate rubbish bins provided, and crockery and cutlery washed and packed away. The Property must be left in a clean and tidy condition.

6.6 Extra cleaning charges may be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc. Should the cleaning fee be more than the usual cost for cleaning the property, you will be charged the additional costs over and above the normal cleaning fee which will be charged to your credit card.

6.7 All furniture and furnishings must be left in the position they were in when you arrived.

6.8 The property should be vacated on time and secured. All windows and doors are to be locked. All keys must be returned as directed.

6.9 You are responsible for the safekeeping and replacement of accommodation keys. Duplicate keys will be provided at an additional charge of:  unit keys- $20, Buggy key- $100.

6.10 Smoking is not permitted in the Property.
